1. Acceptance of Terms
By engaging the services of Lisa Rae Appraisals ("we," "us," or "our"), you ("the Client") agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Scope of Services
We provide professional personal property appraisal services, including insurance appraisals, estate appraisals, fair market value appraisals, auction value. The scope of each appraisal will be defined in a separate engagement letter or agreement.
3. Appraisal Process
- Information Provided: The Client is responsible for providing accurate and complete information about the items being appraised, including ownership, provenance, condition, and any relevant documentation.
- Inspection: We will conduct a thorough inspection of the items, which may include physical examination, photography, and research.
- Appraisal Report: We will provide a written appraisal report detailing our findings and conclusions. The report will be based on our professional opinion and expertise.
- Limitations: Appraisals are based on the information available at the time of the appraisal. We are not responsible for any changes in value or condition that may occur after the appraisal date.
4. Fees and Payment
- Fees: Our fees are based on hourly rate, flat fee, percentage of value depending on extent of contract. Fees will be outlined in the engagement letter or agreement.
- Payment: Payment is due upon completion of the appraisal, within 5 days of invoice. We accept Cash, E-transfer, Bank Draft.
- Expenses: The Client is responsible for any reasonable expenses incurred during the appraisal process, such as travel or research costs.
- Late Payment: Late payments may be subject to late payment penalties, interest charges
5. Client Responsibilities
- Access: The Client must provide us with reasonable access to the items being appraised.
- Cooperation: The Client must cooperate with us during the appraisal process and provide any requested information.
- Insurance: The Client is responsible for insuring the items being appraised.
- Accuracy of Information: The client is responsible for the accuracy of all information provided.
6. Ownership and Copyright
- Appraisal Report: The appraisal report is the property of the Client upon full payment of our fees.
- Copyright: We retain copyright in all appraisal reports, photographs, and other materials created during the appraisal process.
- Usage: The Client may use the appraisal report for its intended purpose, but may not reproduce or distribute it without our written consent.
7. Confidentiality
We will maintain the confidentiality of all information provided by the Client, except as required by law.
8. Limitation of Liability
- Professional Opinion: Our appraisals are based on our professional opinion and expertise. We are not responsible for any errors or omissions in the information provided by the Client.
- Maximum Liability: Our maximum liability to the Client for any claim arising from our services is limited to the fees paid by the Client.
- Indirect Damages: We are not liable for any indirect, consequential, or incidental damages.
9. Termination
Either party may terminate the engagement by providing written notice. The Client is responsible for paying for any services rendered up to the date of termination.
10. Dispute Resolution
Any disputes arising from these Terms and Conditions will be resolved through dispute resolution method mediation, arbitration. The laws of Alberta, Canada, will govern these terms.
11. Governing Law
These Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.
12. Changes to Terms and Conditions
We may update these Terms and Conditions from time to time. We will post any updates on our website and update the "Effective Date" at the top of this document.
